Patna High Court

Sajjid RajaversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Sajjid Raja, was accused in a criminal case for alleged rape of an informant's daughter, creation and viral dissemination of a video of the act, and extortion of Rs. 2 lakh. The victim’s statement, recorded under Section 183 of the Bharatiya Nyaya Sanhita (BNSS), corroborated the prosecution’s case. The petitioner sought anticipatory bail, arguing that the allegations were unfounded. The court examined the seriousness of the offences under the Bharatiya Nyaya Sanhita and the Information Technology Act, and considered the victim’s recorded statement as reliable evidence. Given the gravity of the crimes and the victim’s corroborated testimony, the court refused the petition for anticipatory bail.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner in light of the alleged rape, video dissemination, and extortion?
  • Whether the victim’s statement recorded under Section 183 BNSS can be deemed reliable for denying bail.
