Holding

The Court granted provisional anticipatory bail subject to bail bond, sureties and verification of the petitioner’s criminal antecedent.

Summary

Petitioner Pradeep Kumar feared arrest in a case under Sections 30(a) and 41(1) of the Bihar Excise Act for alleged recovery of 10 litres of liquor from a public spot near the Dhanauti river. He contended that the liquor was not in his possession, the location did not belong to him, and that he was implicated by a watchman with whom he has an inimical relationship. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition of furnishing a bail bond of Rs.5,000 with two sureties and subject to verification of his criminal antecedent under Section 482(2) of the BNSS. If the trial court finds more than one prior case, the bail will not be confirmed; if only one prior case, the provisional bail will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in the pending excise case
  • Whether the petitioner’s alleged antecedent of a prior excise case affects the grant of anticipatory bail
