Holding

The Court granted provisional anticipatory bail subject to bond, sureties, and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Yash Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 60 litres of liquor from a public pond not in his possession. He has two prior cases under the Excise Act and claims the complaint was filed by an inimical chowkidar, raising doubts about the prosecution's case. The State opposed the bail. The Court, applying Section 482(2) of the B.N.S.S., granted provisional anticipatory bail conditioned on a Rs.10,000 bond with two sureties and directed verification of the petitioner’s criminal antecedents. If more than two prior cases are found, the bail will not be confirmed; if exactly two, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the applicable provisions.
  • Whether the conditions imposed, including verification of prior criminal cases, are appropriate.
