Holding
The Court held that bail should be granted to the petitioner.
Summary
The petitioner, Kalkatar Rai, was arrested as the driver of a vehicle from which 1,665 litres of liquor were seized, and was charged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he had no ownership of the vehicle, no knowledge of the contraband, and that no incriminating material was found in his possession. The petitioner also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and pointed to his prior criminal antecedent for which he was already on bail. The State opposed the bail application, arguing the seriousness of the offence. Considering the petitioner’s custody duration, his role as a driver without knowledge of the goods, and the procedural lapse, the Court granted bail on the condition of a Rs.15,000 bond with two sureties and compliance with attendance requirements.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, precludes bail.
- Whether the accused’s status as a driver without knowledge of the contraband affects the bail decision.
