Holding

The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with the conditions imposed.

Summary

Manoj Kumar sought anticipatory bail after being implicated in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Amendment Act, 2018 for alleged recovery of liquor from a motorcycle and an auto. He argued that he had no prior criminal record, was not in actual possession of the liquor, and was unaware that his vehicle would be used for the alleged offence. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.500 with two sureties and conditioning the order on verification of the petitioner’s antecedents by the trial court. If any antecedent is found, the bail will not be confirmed; otherwise it will be confirmed. The order is subject to the provisions of Section 482(2) of the B.N.S.S.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances?
  • Whether the petitioner’s lack of direct possession and clean antecedent justify anticipatory bail?

                                3. Learned counsel for the petitioner submits that

prudent person would use his own vehicle for committing an

occurrence and thus would create evidence against himself and

hence would get implicated. It is also submitted that the

petitioner was completely unaware that Dev would misuse his

vehicle in the manner as alleged, who was also apprehended

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the
