The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of her criminal antecedent.
Summary
Petitioner Parwati Devi sought anticipatory bail after learning that she might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 15 litres of liquor recovered from a joint family house. She argued that the liquor was not in her conscious possession, the house is jointly owned, and the amended Excise Act of 2018 had abolished the concepts of deemed possession and presumed offender. The State opposed the bail, contending that the offence warranted arrest. The Court, considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bond, two sureties, and verification of the petitioner’s criminal antecedent within six weeks. The order further stipulated that if more than one antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith, and the petitioner agreed to deposit Rs.1,500 with the Patna High Court Advocate Association.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in a case of alleged possession under the Bihar Prohibition and Excise Act.
- Whether the concept of deemed possession or presumed offender applies post‑amendment of the Excise Act, 2018.
- Whether the petitioner’s criminal antecedent warrants denial of bail.
