The court granted provisional anticipatory bail subject to verification of the petitioner’s antecedents and compliance with Section 482(2) of the B.N.S.S.
Summary
The petitioner, Shyamdev Yadav, was implicated in a case under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016 for allegedly recovering large quantities of liquor and Mahua from a riverbank. He contended that he has a clean antecedent, that the alleged contraband was not in his possession, and that a hostile chowkidar falsely implicated him. The State opposed his request for anticipatory bail. The Court, after considering the submissions, ordered provisional anticipatory bail on the condition of furnishing bail bonds and two sureties, subject to verification of the petitioner’s criminal antecedents under Section 482(2) of the B.N.S.S. If any antecedent is found, the bail would not be confirmed; otherwise it would be confirmed. The order directs the trial court to verify the antecedents and act accordingly.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the allegations of offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.
- Whether the alleged false implication by a chowkidar and the absence of contraband in the petitioner’s possession affect the grant of anticipatory bail.

implicated at the instance of chowkidar with whom he is on an

of the involvement of the petitioner in the occurrence then why
he did not inform the police prior to institution of the instant

concealed his antecedent before this court, as such, the
