Patna High Court

Rabindra Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court grants bail to the petitioner.

Summary

The petitioner, Rabindra Kumar Yadav, was arrested after 90.75 litres of liquor were recovered from the courtyard of his joint family house and charged under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, claiming innocence, lack of incriminating material in his personal possession, no prior criminal record, and that the recovery was from a shared residence. The State opposed the bail. The court noted the absence of material directly linking the petitioner to the liquor, the short period of custody since 5 January 2026, and the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Considering these factors, the court decided to grant bail, directing the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount.
