The petitioner is entitled to bail in the present case.

Summary

Shilpa Devi, a resident of Diwan Tok, was arrested in connection with a dowry‑death case (Gangabridge P.S. Case No. 149 of 2025) under Sections 80, 238 and 3(5) of the B.N.S., 2023, which correspond to IPC Sections 304B, 201 and 34. The prosecution alleges that the deceased, Nishu Kumari, was killed by her in‑laws after a dowry demand of Rs. four lakhs and a four‑wheeler was not met. The petitioner contended that she is innocent, has no criminal antecedent, and has been falsely implicated, claiming she is the mother‑in‑law (and at one point the husband) of the deceased and has been in judicial custody since 28‑12‑2025. The State opposed the bail application, citing the seriousness of the offences. After hearing both sides, the Court found no sufficient ground to deny bail and ordered the petitioner to be released on a bail bond of Rs.10,000 with two sureties. The bail order was directed to be executed by the Judicial Magistrate, 1st Class, Vaishali at Hajipur.
