Patna High Court

Ranjan Kumar @ VidhyakversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Pre‑arrest bail was denied to the petitioner.

Summary

The petitioner, Ranjan Kumar, applied for pre‑arrest bail in a case (Maner P.S. Case No. 527 of 2024) alleging his involvement in the murder of an informant's husband. The FIR originally named eight accused, but the bail application mistakenly claimed the petitioner was also named; the petitioner argued this was an inadvertent error. The charges include offences under Sections 140(1), 109, 61(2), 3(5) of the BNS and Section 27 of the Arms Act, with Section 103(1) of the BNS later added. The court examined whether the petitioner was truly implicated and considered the seriousness of the alleged joint intention to assault and kill. Finding the allegations serious and the petitioner’s alleged participation in the murder, the judge declined to grant pre‑arrest bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether the petitioner is entitled to pre‑arrest bail despite alleged involvement in a murder.
  • Whether the petitioner’s name is correctly recorded in the FIR for the offences charged.
  • Whether the nature of the offences under the BNS and Arms Act warrants denial of bail.

Legislation cited

  • Arms Act — s. 27
