Patna High Court

Manish KumarversusThe State of Bihar

Decided
Disposal

Holding

The Court granted regular bail to the petitioner.

Summary

Manish Kumar was arrested in connection with a case registered under several serious offences of the Bhartiya Nyaya Sanhita, 2023, based on police testimony that he fled the scene and mobile phones recovered from him contained WhatsApp chats showing financial transactions of strangers. The petitioner contended that he was falsely implicated due to village politics, no incriminating article was found on him, and that co‑accused in similar circumstances had been granted bail. He had been in judicial custody since 25‑11‑2025 and had no prior criminal record. The State opposed the bail application. The High Court, after considering the facts and the lack of direct evidence, ordered the petitioner to be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious charges under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the mobile phone evidence and alleged financial transactions constitute sufficient ground to deny bail.
  • Whether precedent of bail granted to co‑accused in similar cases warrants granting bail to the petitioner.

                   336(2), 336(3), 338, 340(2) and 111 of the Bhartiya Nyaya

                   Sanhita, 2023.

                                3. As per the prosecution case, the informant states

                                   4. Learned counsel for the petitioner submits that the

petitioner has been falsely implicated in the case due to village

politics. No incriminating article has been recovered from the

petitioner's possession. It is further contended that similarly

situated co-accused persons has been granted bail by a co-

ordinate Bench of this Court vide order dated 12.03.2026 passed

petitioner is in judicial custody since 25.11.2025 having no

                      criminal antecedent.

                                   5. Learned APP appearing for the state has opposed

                      the prayer of regular bail.

                                   6. Considering the aforesaid facts and circumstances

of the case, this court is inclined to enlarge the petitioner on

bail. The above named petitioner is directed to be released on

bail in connection with Muffasil P.S. Case No. 478 of 2025 on

furnishing bail bond of Rs.10,000/- (ten thousand) with two
