The court granted bail to the petitioner with specified conditions.

Summary

The petitioner, Nagendra Mahto, applied for bail in a case registered as Sarai Ranjan P.S. Case No. 113 of 2024 under Section 309(4) of the B.N.S., 2023, alleging that he was falsely implicated in a robbery of a bolero pickup. The prosecution alleged that two unknown miscreants committed the robbery, but a confessional statement by an apprehended suspect named the petitioner, though no material evidence was recovered from him. The petitioner contended his innocence, highlighted the lack of recovered items, and pointed out his prolonged judicial custody since November 2024. The State opposed bail, citing the petitioner's alleged criminal antecedent of twenty‑one cases. After hearing both sides, the court granted bail on the condition of cooperation with the trial, regular attendance before the trial court, weekly reporting to the police station, and furnishing a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under Section 309(4) of the B.N.S., 2023 despite the prosecution's claim of a criminal antecedent.
