Patna High Court

Angad Kumar @ Jadu YadavversusThe State of Bihar

Decided

Holding

The Court ordered that the petitioner be released on bail upon furnishing the prescribed bond and sureties.

Summary

Angad Kumar was arrested in connection with a shooting incident in which Santosh Kumar was injured in the left forearm. He was charged under Sections 109 and 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act. The petitioner claimed he was falsely implicated, citing a land dispute and that only a single shot was fired, indicating lack of intent, and argued that he had been in judicial custody since 18‑11‑2025. The State opposed bail, pointing to a prior criminal case. After hearing both sides, the Court found the circumstances sufficient to grant bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the accused in a case involving offences under the B.N.S., 2023 and the Arms Act, considering the alleged facts and the petitioner’s prior criminal antecedent.
