Provisional anticipatory bail is granted subject to bail bond, sureties and verification of the petitioner’s criminal antecedent.

Summary

Sunil Kumar applied for anticipatory bail fearing arrest in a case under Sections 30(a) and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 220 litres of liquor were recovered from a motorcycle he did not own. He claimed the police, prompted by a local chawkidar, had implicated him without proper investigation and that nothing was found in his conscious possession. The State opposed the bail. The Patna High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties and subject to verification of his criminal antecedents. The court directed that if more than one prior case is found, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed immediately. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances?
  • Whether the petitioner’s alleged lack of ownership of the seized vehicle and absence of conscious possession justify bail?
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail?
