Patna High Court

Jagdish SinghversusThe State Of Bihar

Decided
Disposal
DISPOSED

Holding

The petition is dismissed as the matter has become infructuous.

Summary

The petitioner, Jagdish Singh, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash an order dated 04.01.2018 passed by the Additional Sessions Judge, which had rejected his petition and denied him the opportunity to examine witnesses, including the injured and the informant. The petitioner argued that the case had become infructuous and should be disposed of. The State of Bihar raised no objection to the petitioner's prayer. The Court considered the submissions and found that the proceedings were indeed infructuous. Consequently, the Court disposed of the petition without granting any relief. The order reflects the Court’s discretion to dismiss a petition when the underlying matter no longer warrants judicial intervention.

Issues considered

  • Whether the order of the Additional Sessions Judge rejecting the petitioner's petition and denying examination of witnesses should be quashed under Section 482 Cr.P.C.
  • Whether the petition is infructuous and therefore liable to be disposed of.
