Patna High Court

Samir KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court inclined to grant bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Samir Kumar, was arrested in connection with a case involving the recovery of 741 litres of liquor and an alleged attempt by the driver to assault police. He was charged under Section 109 of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, no liquor was found in his possession, and there was no compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, citing the seriousness of the offences and the petitioner’s five prior criminal antecedents. Considering the circumstances, the court granted bail subject to a cash bond, two sureties, and conditions including appearance at trial, non‑tampering with evidence, and non‑commission of similar offences.

Issues considered

  • Whether the petitioner is entitled to bail despite the nature of the offences under the Bharatiya Nyaya Sanhita and the Bihar Prohibition and Excise Act
  • Whether the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, affects the grant of bail
  • Whether the petitioner’s prior criminal antecedents justify denial of bail
