Provisional anticipatory bail is granted subject to verification of the petitioner's criminal antecedent and compliance with the stipulated conditions.
Summary
Shiv Shankar Mahto was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 16.575 litres of liquor from a motorcycle he owned. He contended that he had a clean antecedent, was not in possession of the liquor at the time of arrest, and was unaware that a friend misused his vehicle. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds and two sureties, and that the trial court verify his criminal antecedent. If any antecedent is discovered, the bail will not be confirmed; if he is found to have a clean record, the provisional bail will be confirmed.
Issues considered
- Whether anticipatory bail should be granted to a person accused under Section 30(a) of the Bihar Excise Act when the alleged offence involved liquor recovered from a vehicle he owned but was not in his possession.
