Sanjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court grants bail to the petitioner.

Summary

The petitioner, Sanjeet Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 354.240 litres of liquor. He contended that he was merely the driver of the tempo, had no knowledge of the contraband, and that no incriminating article was found in his possession. The petitioner also highlighted the absence of any prior criminal record and the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, but the Court, considering the facts, the period of custody, and the lack of direct evidence against the petitioner, decided to grant bail. Bail was set at Rs. 15,000 with two sureties, subject to conditions of family surety, regular appearance, and possible cancellation on default.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of alleged false implication and lack of direct evidence.
