Patna High Court

Nitesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions.

Summary

The petitioner, Nitesh Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 1,163.7 litres of liquor. He contended that he was merely the driver of the vehicle, had no knowledge of the contraband, and was falsely implicated, also noting the absence of the incriminating article in his conscious possession and lack of ownership of the vehicle. The State opposed bail, arguing the seriousness of the offence. The court examined the facts, the petitioner’s clean record, the period of custody, and the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, and decided to grant bail. Bail was conditioned on a bond of Rs. 15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s regular appearance before the trial court.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the accused’s claim of being a driver without knowledge of the contraband negates the presumption of guilt.
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail.
