Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the B.N.S.

Summary

The petitioner, Chhotu Ansari, applied for anticipatory bail fearing arrest in a case registered under multiple sections of the B.N.S. The FIR alleges that, on orders of the S.D.O., the petitioner was part of a group that created a ruckus and assaulted police in Bela village. The petitioner contended that he is already on bail in another case and that the allegations against him are vague, general, and he has been falsely implicated. The State opposed the anticipatory bail. The Court, after considering the submissions, directed that the petitioner be released on anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S., should he be arrested or surrender within six weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances alleged in the FIR
  • Whether the allegations against the petitioner are sufficiently specific to deny bail
