Patna High Court

Ravi KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Ravi Kumar was arrested for alleged possession of 241.920 litres of liquor recovered from a vehicle, charged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was only the driver, not the owner, had no knowledge of the liquor, and possessed no incriminating article, while also having no prior criminal record. The State opposed his bail application. The court noted the lack of conscious possession, the petitioner’s custodial period since 11‑12‑2025, and the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, but found these insufficient to deny bail. Accordingly, the court granted bail on a bond of Rs.15,000 with two sureties, subject to conditions of family surety, regular appearance, and possible cancellation on default.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail.
