BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners.

Summary

The petitioners, Raju Noniya and Ghanshyam Paswan, applied for anticipatory bail in a murder case registered under Sections 103(2) and 3(5) of the Bharatiya Nyaya Sanhita. The prosecution’s case is based on a report by informant Mohan Kumar, who claimed his brother was killed by the petitioners, but he is not an eye‑witness and did not disclose how he obtained the information. No witness has positively identified the petitioners, and a co‑accused in the same case has already been granted bail. The petitioners asserted a clean antecedent, while the State opposed the bail. Considering the lack of direct evidence and the circumstances, the court granted anticipatory bail with a bond of Rs.10,000 and two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bharatiya Nyaya Sanhita in the absence of eye‑witness testimony.
