Prince Kumar PandeyversusThe State of Bihar

Holding

The court held that provisional anticipatory bail may be granted subject to verification of the petitioner’s criminal antecedent, and if more than one antecedent is found, the bail will not be confirmed.

Summary

Prince Kumar Pandey was charged under Sections 30(a), 32(i)(iii) and 41(i)(ii) of the Bihar Excise Act for the alleged recovery of 72.280 litres of liquor from a vehicle he owned. He argued that he was not present at the spot of seizure, had no conscious possession of the liquor and was unaware that his friend misused the vehicle. The petitioner sought anticipatory bail, contending that the defect pointed out by the office had been removed. The court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds and two sureties, and that the trial court verify his criminal antecedent. The order stipulated that if more than one prior case is found, the bail would not be confirmed; otherwise it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the excise case.
  • Whether the defect identified by the office has been removed.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

for the petitioner, the defect as pointed out by the office is

                   hereby removed.

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

vehicle. It is next submitted that no prudent person would use

his own vehicle for committing an occurrence and thus would

create evidence against himself and hence would get implicated,

it is further submitted that petitioner was completely unaware

that his friend would misuse the vehicle in the manner as

alleged, who also fled from the spot.

                   7. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   8. Considering the submissions made by the learned

Court shall verify the criminal antecedent of the petitioner and

in the event if it is found that petitioner has antecedent of more

than one case then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his

                        confirmed forthwith.
