Akash Poddar @ Akash KumarversusThe State of Bihar

Holding

The Court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s antecedent record.

Summary

The petitioner, Akash Poddar, sought anticipatory bail after learning of a case registered under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 400 litres of liquor from a Tata Sumo Gold vehicle. He argued that he was not arrested at the scene, had no possession of the liquor, was not the vehicle's owner, and was implicated solely on a confessional statement made by a co-accused in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence and the petitioner’s prior three excise cases. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedents. The order stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in view of the alleged excise offence and his prior criminal antecedents.
  • Whether a confessional statement made by a co-accused in police custody can alone justify the issuance of a non-bailable warrant.
  • Whether the police investigation was conducted in accordance with procedural requirements before implicating the petitioner.
