Patna High Court

Ramesh Kumar RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioners.

Summary

The petitioners, Ramesh Kumar and his wife Soni Kumari, were arrested after 468 litres of liquor were recovered from a pick‑up vehicle in Gopalganj. They claimed innocence, stating that the vehicle belonged to the petitioner but he had no knowledge of the liquor and that no incriminating material was found on them. The prosecution charged them under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act. The petitioners argued lack of criminal antecedent, prolonged custody since 4 December 2025, and non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail. Considering the facts, the court granted bail, ordering each petitioner to furnish a bail bond of Rs 15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act.
  • Whether the requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, have been satisfied to justify bail.
  • Whether the prolonged pre‑trial custody and lack of criminal antecedent warrant release on bail.
