The court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Pramendra Ram, applied for anticipatory bail after a case was registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging recovery of 72 litres of liquor from a washroom in his house. He argued that he has a clean antecedent, the liquor was found in a joint family property, and there was no direct recovery from his conscious possession, making attribution to him uncertain. The prosecution opposed the bail, but the court noted that the concept of deemed possession had been removed by the 2018 amendment and the informant’s name was omitted from the FIR, weakening the case. The court directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his antecedent and conditions under Section 482(2) of the B.N.S.S. The order will be confirmed if his clean antecedent is verified; otherwise it will be set aside.

Issues considered

  • Whether anticipatory bail should be granted under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the alleged possession of liquor in a joint family house can be attributed to the petitioner.
  • Whether the omission of the informant’s name in the FIR affects the prosecution’s case.
