Patna High Court

Rajan Kumar PatelversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Rajan Kumar Patel, was arrested as the driver of a pick‑up from which 172.80 litres of liquor were seized, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise Act. He claimed innocence, stating he had no knowledge of the goods and that no incriminating material was found in his possession, and highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail. Considering the facts, the petitioner’s clean record, and the period of custody already served, the Court inclined to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties, subject to conditions of personal surety, regular appearance, and non‑interference with evidence or witnesses. Violation of any condition would permit cancellation of bail.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the bail application.
  • Whether the petitioner’s role as driver and lack of prior criminal record justify bail.
