BAIL GRANTED

Holding

The petitioners are entitled to anticipatory bail subject to the conditions imposed by the Court.

Summary

The petitioners, Ashok Rajak and Gareeb Yadav, sought anticipatory bail fearing arrest in a case involving alleged assault, firearm discharge, and robbery under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The prosecution alleged that the accused, including co‑accused Kshatri Yadav and Vikas Yadav, fired at a minor’s father, causing injury and stealing cash and a gold chain. The petitioners contended they were merely members of a mob in a land‑dispute context and were falsely implicated, with one having no prior criminal record. The State opposed the bail. The Court, after considering the facts, granted anticipatory bail subject to a bond of Rs.15,000 and two sureties, invoking Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
  • Whether the allegations against co‑accused extend to the petitioners warranting their arrest.
