Patna High Court

Shankar KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the absence of incriminating material, the petitioner’s lack of antecedents, and non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, bail should be granted.

Summary

Shankar Kumar was arrested after 279 litres of Nepali liquor were seized from two motorcycles and charged under Sections 274, 275, 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was merely a passerby, not the owner of the motorcycles, and that no incriminating material was found in his possession; he also highlighted his clean record and the alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail. Considering the lack of direct evidence, the petitioner’s antecedents and the procedural lapse, the Court inclined to grant bail. The order directed the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount. The bail was consequently granted, and the petitioner was released.

Issues considered

  • Whether bail should be granted to the petitioner in view of the alleged offences under the Bharatiya Nyaya Sanhita and Bihar Prohibition and Excise Act
  • Whether the procedural requirement of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been complied with
  • Whether the petitioner’s custody period, lack of incriminating material and clean antecedents justify the grant of bail
