Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Sunil Manjhi, applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where liquor was allegedly recovered from his house and another house. He contended that he was not arrested on the spot, that the liquor was in a joint family property and that he had no conscious possession, arguing that the concept of deemed possession was removed by the 2018 amendment. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 and two sureties of the same amount, under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The order also directed the trial court to verify the petitioner’s criminal antecedent, with the bail to be confirmed only if he has at most one prior case.
Issues considered
- Whether anticipatory bail can be granted in a case of alleged possession of liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the alleged possession in a joint family house and lack of conscious possession negate the grounds for arrest.
- Whether the amendment removing the concept of deemed possession affects the bail application.

had kept the liquor in the house or the liquor kept in the house
was within his knowledge and after amendment in the Excise
Act in the year 2018, the concept of deemed possession and

it is found that petitioner has antecedent of more than one case,

it would be presumed that petitioner had concealed his
antecedent before this Court at para 3 of the anticipatory bail
application in that event the provisional anticipatory bail order
shall not be confirmed but if it is found on verification that
petitioner has antecedent of only one case in that event the
provisional anticipatory bail order shall be confirmed forthwith.
