Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no sufficient grounds to keep him in custody.

Summary

The petitioner, Jayshankar Yadav, was arrested after 57.48 liters of liquor were recovered from his joint family house, leading to charges under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed innocence, arguing that no liquor was found in his personal possession, he has no prior criminal record, and the recovery was from a shared residence. The petitioner also highlighted non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the court considered the lack of incriminating material, the petitioner’s clean record, and the length of custody. Consequently, the court granted bail on the condition of a Rs. 15,000 bond with two sureties.
