Holding
The court held that, considering the petitioner’s clean antecedent and the nature of the allegations, bail should be granted subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
Satyonjeet Sinha applied for anticipatory bail in a case (Begusarai Town PS Case No.469 of 2025) alleging his involvement in a false insurance fraud scheme under Sections 318, 318(4), 316 and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner contended that he was merely a former hospital supervisor with no role in the alleged fraud and had left the hospital in 2023. The State opposed the bail, arguing the seriousness of the charges. The court examined the petitioner’s clean antecedent, the nature of the allegations, and the fact that a co‑accused had already been granted anticipatory bail. Relying on Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to conditions. The order effectively granted anticipatory bail to the petitioner.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the allegations under Sections 318, 318(4), 316 and 3(5).
- Whether the petitioner’s clean antecedent and lack of involvement in the alleged fraud justify the grant of bail.
