BAIL GRANTED

Holding

The court granted bail to the petitioners subject to a bond of Rs. 10,000 each with two sureties, under Section 482(2) of the B.N.S.

Summary

The petitioners, Bhuneshwar Singh and Lalji Singh, sought bail fearing arrest in connection with Nawanagar Police Station Case No. 92 of 2025, which alleged offences under several sections of the B.N.S. The prosecution alleged that the petitioners assaulted an informant and his family, while the petitioners claimed false implication and cited a prior criminal antecedent. The State opposed bail, but the court observed that the FIR contained only general, omnibus allegations and the injury to the informant was minor. Considering the lack of specific charges and the nature of the injury, the court deemed bail appropriate. The court ordered that the petitioners be released on bail upon furnishing a bond of Rs. 10,000 each with two sureties, subject to conditions under Section 482(2) of the B.N.S. The order was pronounced by Justice Ramesh Chand Malviya.

Issues considered

  • Whether the petitioners are entitled to bail in view of the general nature of the allegations and the minor injury sustained by the informant
  • Whether the conditions under Section 482(2) of the B.N.S. justify granting bail
