Holding

The Court ordered provisional anticipatory bail for the petitioner, subject to conditions and verification of her antecedent.

Summary

Mamta Devi, the owner of two motorcycles, was implicated in a case alleging the recovery of 141.75 litres of liquor and charged under Sections 274 and 275 of the Bihar Narcotic Substances Act, 2023 read with Section 30(a) of the Bihar Excise Act. She contended that she had no knowledge of the liquor being transported in her vehicles and that the actual offender, Rajiv, was apprehended at the scene. The petitioner, a woman with a clean antecedent, sought anticipatory bail, while the State opposed the relief. The Court, after considering the submissions, granted provisional anticipatory bail subject to a modest bail bond, two sureties, and verification of the petitioner’s criminal record. It directed that if any antecedent is discovered, the bail would be revoked; otherwise, the provisional order would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of alleged involvement in offences under Sections 274 and 275 of the Bihar Narcotic Substances Act, 2023 and Section 30(a) of the Bihar Excise Act.
