Ranjeet Kumar YadavversusThe State of Bihar

The court allowed the anticipatory bail, granting provisional bail subject to bond, sureties and verification of antecedents.

Summary

Petitioner Ranjeet Kumar Yadav sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. He argued that the allegations were based on a confessional statement made in police custody, which he claimed lacked evidentiary value, and that the 2018 amendment had abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 and two sureties, with conditions under Section 482(2) of the applicable law, and directed verification of the petitioner’s criminal antecedents. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
  • Whether a confessional statement made in police custody is admissible for implicating the petitioner.
  • Effect of the 2018 amendment removing deemed possession and presumed offender on the grant of anticipatory bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
