The court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of criminal antecedents.
Summary
The petitioner, Nitish Kumar, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that the alleged recovery of 5 litres of liquor was from a bamboo orchard not belonging to him and that he was implicated by a hostile chowkidar. The State opposed the bail application. The High Court, after hearing both sides, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.5,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S. The order also mandated verification of the petitioner’s criminal antecedents, stating that if more than one prior case is found, the bail would not be confirmed, whereas confirmation would follow if only one antecedent exists. The court thus granted the anticipatory bail application conditionally.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under the circumstances alleged.
- Whether the alleged recovery of liquor establishes sufficient grounds for arrest.
- Whether the petitioner’s criminal antecedents affect the grant of anticipatory bail.
