The court allowed the anticipatory bail application, granting provisional anticipatory bail subject to bond and verification of antecedent.
Summary
Prem Prakash Kumar was implicated in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for allegedly transporting 500 ml of liquor in a motorcycle he owned. He argued that he had a clean antecedent, was not in actual possession of the liquor, and was unaware that another person would misuse his vehicle. The State opposed his anticipatory bail application. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of his criminal antecedent. The order stipulated that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under the circumstances of alleged possession through ownership of the vehicle.
- Whether the petitioner’s lack of actual possession and clean antecedent justify the grant of anticipatory bail.
