The Court conditionally granted provisional anticipatory bail to the petitioner.
Summary
The petitioner, Ranglal Manjhi, sought anticipatory bail fearing arrest in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged possession of 20 litres of liquor and 200 litres of semi‑prepared liquor recovered from a joint family house. He argued that he was not arrested at the spot, that the liquor was not in his conscious possession, and that the 2018 amendment to the Excise Act had abolished the concepts of deemed possession and presumed offender. The State opposed the bail, contending the allegations warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on furnishing bail bonds and sureties, and subject to verification of the petitioner’s criminal antecedents under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The order stipulated that if more than one antecedent case is found, the bail would not be confirmed; otherwise it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether the petitioner can be deemed to have possession of the liquor under the amended Excise Act.
- Whether the provisions of Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S. are applicable.
