Patna High Court

Lala Yadav @ Shambhu KumarversusThe State of Bihar

Holding

The High Court granted provisional anticipatory bail, subject to verification of antecedents and compliance with bail conditions.

Summary

The petitioner, Lala Yadav, sought anticipatory bail after a case was registered against him under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for alleged recovery of 23.75 litres of liquor. He argued that the liquor was seized from a location not belonging to him, that nothing was found in his possession at the time of arrest, and that the prosecution’s case relied on undisclosed informant information. The State opposed the bail, contending that the allegations warranted detention. The Court, after considering the submissions, ordered provisional anticipatory bail on the condition of furnishing a bail bond of Rs.5,000 with two sureties and subject to verification of the petitioner’s criminal antecedents. It further directed that if more than one prior case is found, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed. The order was made under Section 482(2) of the relevant Bihar statute.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
  • Whether the lack of seizure from the petitioner’s possession and reliance on secret informant information affect the grant of bail.
  • Whether the petitioner’s criminal antecedents should condition the confirmation of anticipatory bail.

                                2. The petitioner apprehends his arrest in a case

recovery of 23.75 litres of liquor from four bags near Lahthan

Bhawan. It is next submitted that petitioner was not arrested

from the spot as such nothing was recovered from his conscious

possession and even alleged recovery is from a place which

does not belong to the petitioner and he came to be implicated at

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the
