Anticipatory bail was granted to petitioner No.2 (Ramiqbal Yadav) and denied to petitioner No.1 (Ramavtar Yadav).
Summary
The petitioners, brothers Ramavtar Yadav and Ramiqbal Yadav, were named in FIR No.93/2025 for assault offences under the Bhartiya Nyaya Sanhita, 2023, arising from a land dispute in Marauna village. The FIR alleged that Ramavtar assaulted the informant’s son with an iron danda, while Ramiqbal assaulted a person with a rod, causing injuries to both parties. Both petitioners sought anticipatory bail, claiming innocence, mutual scuffling, and that a parallel case (No.92/2025) existed. The State opposed bail, highlighting the seriousness of the assault and the petitioners’ pending criminal antecedents. The Patna High Court granted anticipatory bail to Ramiqbal on a Rs 30,000 bond with conditions, but rejected the anticipatory bail for Ramavtar, directing the trial court to consider his surrender‑cum‑bail application if he surrenders within four weeks.

- Whether anticipatory bail should be granted to Ramavtar Yadav under the Bhartiya Nyaya Sanhita, 2023.
