Holding

Provisional anticipatory bail is granted subject to bail bond, sureties and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Dharmendra Nut, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, alleging that the alleged seizure of 60 litres of liquor occurred on land not owned by him and that a chowkidar’s testimony implicated him without prior police notice. He has two prior criminal cases, one also under the Excise Act. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail on the condition of furnishing a bail bond of Rs.10,000 with two sureties and directed the trial court to verify his criminal antecedents. If more than two prior cases are found, the bail will not be confirmed; if exactly two, it will be confirmed forthwith. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the B.N.S.S. in a case under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail

                                3. Learned counsel for the petitioner submits that
