The Court granted regular bail to the petitioner.

Summary

The petitioner, Bharat Singh, was arrested in connection with a case registered under multiple sections of the Bharatiya Nyaya Sanhita for allegedly entering an informant's courtyard and participating in a mob that later sprinkled petrol, causing burn injuries. The prosecution alleged that other accused members of the mob ignited the petrol, while the petitioner contended that he only entered the courtyard to dig and did not partake in the arson or any violent act. The petitioner, who has no prior criminal record and has been in judicial custody since 18‑10‑2025, sought regular bail. The State opposed the bail on the ground of the seriousness of the offences. After considering the petitioner’s limited role, lack of antecedents, and the principle of bail, the Court granted regular bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under sections relating to arson, attempt to cause injury, and other serious offences under the Bharatiya Nyaya Sanhita.

2 12-03-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                2. The petitioner has prayed for regular bail in a case

registered for the offence punishable under Sections 115(2),

                   126(2), 189(2), 191(2), 333, 118(2), 109 & 124(1) of the

                   Bharatiya Nyaya Sanhita.

                                3. The case of the prosecution, in short, is that the

petitioner along with others entered in the courtyard of the

informant and started digging. It is further alleged that one

Dasrath Prasad Singh exhorted his nephew and daughter to

sprinkle petrol. Then one Chandan Kumar Singh, Snehasmriti

and Faagu Yadav sprinkled petrol and Dasrath Prasad Singh put

matches due to which informant got burn injuries.

                                4. Learned counsel for the petitioner submits that

                                                        2/2

from perusal of the FIR itself it is clear that only allegation

against the petitioner is that he along with others entered in the

courtyard of the informant and started digging. Learned counsel

for the petitioner has submitted that petitioner is only a member

of the mob; he has neither exhorted nor sprinkled petrol on

anybody. Learned counsel for the petitioner has submitted that

petitioner is having no criminal antecedent and he is in judicial

                      custody since 18.10.2025.

                                   5. Learned APP appearing for the state has opposed

                      the prayer of regular bail.

                                   6. Considering the aforesaid facts and circumstances

of the case, this court is inclined to enlarge the petitioner on

bail. The above named petitioner is directed to be released on

bail in connection with Manihari P.S. Case No. 179 of 2025 on

furnishing bail bond of Rs.10,000/- (ten thousand) with two

sureties of the like amount each to the satisfaction of learned

                      Chief Judicial Magistrate, Katihar.
