Patna High Court

Sanjay ChoudharyversusThe State of Bihar

Decided

Holding

The court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s antecedent convictions.

Summary

The petitioner, Sanjay Choudhary, applied for anticipatory bail after a case was registered under Section 30(a) of the Bihar Excise Act alleging recovery of 6.75 litres of liquor from his house, which is a joint family property. He argued that the liquor was not in his conscious possession, that the concept of deemed possession had been removed by the 2018 amendment, and that the complaint was filed by a hostile chowkidar without proper investigation. The State opposed the bail. The High Court, considering these submissions, granted provisional anticipatory bail on the condition that the petitioner surrender within six weeks, furnish bail bonds of Rs.10,000 with two sureties, and be subject to verification of his criminal antecedent. The court stipulated that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the provisional order would be confirmed. The order was made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the CrPC in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the alleged possession of liquor in a joint family house can be imputed to the petitioner.
  • Whether the petitioner’s prior convictions affect the grant of anticipatory bail.

                   learned A.P.P. for the State.

                             2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner has antecedent of two cases under the Excise Act and

allegation is of recovery of 6.75 litres of liquor from the house

                   of the petitioner.

the house or the liquor kept in the house was within knowledge

of the petitioner. It is next submitted that after amendment in

the Excise Act in the year 2018, the concept of deemed

possession and presumed offender has been done away with and

he came to be implicated at the instance of Chowkidar with

whom he is on an inimical term. It is further submitted that once

an accused is implicated in a case relating to excise, the police

starts implicating mechanically either at the instance of

Chowkidar, local person, confessional statement or secret

information without holding a proper investigation.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the event

of his arrest or surrender before the learned trial court within a

period of six weeks from today, be released on Provisional
