BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to bond and conditions.

Summary

The petitioner, Soman Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 100 litres of liquor near a riverbank. He claimed innocence, stating that no incriminating material was found in his possession and that the liquor was recovered from an open area accessible to all. The petitioner had been in custody since 19‑12‑2025 and possessed five prior criminal antecedents, and the prosecution noted non‑compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the Court, after considering the facts, the period of custody, and the lack of direct evidence against the petitioner, decided to grant bail subject to a bond of Rs.15,000 with two sureties and several conditions. The order directed the petitioner to appear at all trial dates, not tamper with evidence or witnesses, and not commit a similar offence.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act despite prior criminal antecedents and non‑compliance with Section 103 of the BNSS, 2023.
