BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to conditions, based on the victim’s 164 statement and the precedent treating a 16‑17‑year‑old as a major.

Summary

Vikesh Paswan applied for anticipatory bail in a case alleging kidnapping, rape and offences under the POCSO Act involving a 16‑year‑old girl. The FIR was lodged 15 days after the alleged incident, and the petitioner claimed false implication. The victim’s statement under Section 164 of the Cr.P.C. asserted that she left her home to marry the petitioner, was 17 years old, and is now living a happy conjugal life. The petitioner’s counsel relied on a 2010 Patna High Court decision that treats a girl aged 16‑17 as a major. The court, considering the victim’s statement and the precedent, allowed anticipatory bail with a bail bond and sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted despite allegations under the POCSO Act.
  • Whether the victim’s age (16‑17) renders the POCSO provisions inapplicable.
  • Whether the delay in filing the FIR affects the merits of the prosecution.
