The court granted provisional anticipatory bail, subject to verification of the petitioner’s antecedent and compliance with Section 482(2) conditions.

Summary

The petitioner, Rajnish Kumar, sought anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act, alleging that he was implicated without being caught in possession of 25 litres of liquor and that the FIR was based on undisclosed information. He asserted a clean criminal record and argued that the seizure was from a vehicle he did not own. The State opposed the bail. The High Court, after considering the submissions, directed the petitioner to be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his antecedent and compliance with conditions under Section 482(2) of the B.N.S.S. The order was made conditional: if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s clean antecedent justifies the grant of anticipatory bail.
  • Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are applicable.
