DISPOSED

Holding

Anticipatory bail is granted to petitioner no. 2 subject to the conditions stipulated.

Summary

The petitioners, Deepak Kumar and Bittu Singh, filed anticipatory bail applications in a case involving alleged assault under multiple sections of the Bharatiya Nyaya Sanhita. Deepak Kumar's application was withdrawn after his arrest. Bittu Singh claimed innocence, arguing that the allegations were vague and no specific overt act was attributed to him, and cited that co‑accused had been granted anticipatory bail in a similar case. The State opposed the bail. The Court, considering the nature of the accusations and precedent, granted anticipatory bail to Bittu Singh, subject to a bail bond of Rs.10,000, two sureties, and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita within eight weeks of arrest.

Issues considered

  • Whether anticipatory bail should be granted to petitioner no. 2 despite the serious offences alleged under the Bharatiya Nyaya Sanhita.
  • Whether the allegations against petitioner no. 2 are sufficiently specific to deny bail.
  • Whether the conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita justify granting anticipatory bail.
