Patna High Court

Jay Prakash Singh @ Prakash Singh @ Jai Prakash SinghversusThe State of Bihar

Holding

The Court granted bail, holding that the vague and general nature of the allegations did not justify continued detention despite the petitioner’s criminal antecedents.

Summary

The petitioner, Jay Prakash Singh, applied for bail in a case registered under multiple sections of the B.N.S., 2023, alleging that he was falsely implicated in an assault on an informant and his family. The prosecution contended that the petitioner, along with others, had abused and assaulted the informant. The petitioner’s counsel argued that the allegations were vague, omnibus, and stemmed from a trivial dispute, with no specific charge against him, and highlighted his prolonged judicial custody since December 2025. The State opposed bail, citing the petitioner’s two prior criminal cases. After hearing both sides, the Court found the allegations insufficiently specific and, despite the antecedents, ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted in a case involving multiple serious charges under the B.N.S., 2023 despite the petitioner’s prior criminal antecedents
  • Whether the nature of the allegations (general and omnibus) warrants denial of bail
