Patna High Court

Suman KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and conditions.

Summary

The petitioner, Suman Kumar, was arrested in connection with a case involving the alleged exploitation and torture of two minor girls at a local orchestra, charged under multiple sections of the Bhartiya Nyaya Sanhita, 2023, the Child Labour (Prevention and Regulation) Act, 1986, and the Juvenile Justice Act, 2015. He sought bail, claiming innocence and that his detention was based solely on suspicion without direct evidence. The prosecution opposed the bail, emphasizing the seriousness of the offences. The court noted the petitioner’s prolonged custody since 21‑11‑2025 and the fact that a similarly situated co‑accused had been granted bail. Considering these factors, the court allowed the bail application, imposing a bond of Rs.10,000 with two sureties and several conditions regarding court appearances and police station attendance.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the Bhartiya Nyaya Sanhita, Child Labour Act and Juvenile Justice Act
  • Whether the petitioner’s prolonged pre‑trial detention and the grant of bail to a co‑accused warrant relief
