Patna High Court

Ranjeet RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to monetary and procedural conditions.

Summary

Ranjeet Rai was arrested in connection with the recovery of 2,960 litres of spirit from a truck, alleged to violate Sections 318(4), 338, 336(3) and 340(2) of the Bharatiya Nyaya Sanhita, 2023 and several provisions of the Bihar Prohibition and Excise Act. The petitioner contended that he was neither the owner nor the driver of the vehicle, that the liquor was planted, and that no incriminating material was found in his possession, while also pointing out a lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, emphasizing the seriousness of the offence and the petitioner’s twelve prior criminal antecedents. After considering the facts, the court found the petitioner’s claim of innocence plausible and, despite his antecedents, decided to grant bail. Bail was conditioned on a bond of Rs. 15,000 with two sureties, a family member as one bailor, mandatory appearance at trial dates, and cancellation provisions for future similar offences.

Issues considered

  • What is the appropriate discretion of the court in granting bail to an accused charged under the Bharatiya Nyaya Sanhita and the Bihar Prohibition and Excise Act, considering the seriousness of the offence and the accused’s prior criminal record?
  • Whether the alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
